We’ve filed a lawsuit to defend the rights of EPA workers.
Today, AFGE Council 238 filed a lawsuit against EPA management to restore our union contract and the workplace protections it provides to nearly 8,000 EPA workers.
When the EPA revoked our contract, workers lost critical protections – including the right to have union representation in meetings that could lead to discipline, and the ability to challenge workplace actions through our negotiated grievance process.
We’ve already seen what’s at stake. More than 140 EPA workers who signed a Declaration of Dissent on June 30, 2025 were placed on administrative leave, and workers later faced suspensions and terminations after our contract was revoked. Council 238 is fighting to get those protections back.

Without a contract, EPA management has more power to act without being challenged – leaving workers without protections and fewer tools to fight back.
This lawsuit is an important step in fighting for the protection of workers whose expertise and public service keep our air and water clean in order to keep our communities safe. We’re working to restore the protections EPA workers fought so hard for through collective bargaining and to make clear that the Administration can’t strip us of our voice.
This fight isn’t just in the courtroom – and it won’t be resolved overnight. As this fight unfolds, we’re asking members to stay informed, talk to your coworkers, share your own stories and show up when there are opportunities to take action.
